Citizenship through the mother

“… The Court grants the appeal, annuls the contested sentence and, deciding on the merits in accordance with art. 384 of the Code of Civil Procedure: a) accepts the request of Elia Mariam, born in Cairo (Egypt) on 4 September 1962 and declared her an Italian citizen; b) Orders the Ministry of the Interior and, in their name, the competent civil registry officer, who carry out the registrations, transcriptions and annotations required by law, in civil registration records, of the person's nationality indicated, providing any communications to the consular authorities competent; c) compensates the costs of the entire process between the parties…” – February 3 2009.

There is years, the Mignacca law firm has successfully handled cases before the Court of Rome to obtain Italian citizenship "ius sanguinis" through maternal descendants born before January 1, 1948, since the latter, for law, must necessarily initiate action in Italy.

Our office, made up of a team of experts, with competence and professionalism, accompanies the client in all phases of the procedure:

  • Document analysis: this preliminary examination of Documents that attest to descent aim to identify irregularities or defects that could lead to a negative judicial decision, with consequent unnecessary waste of time and money. All Brazilian certificates must then be translated by a sworn translator into Italian and subsequently handouts; in this way they acquire legal value in Italy.

  • Legal action before the Court for the request for Italian citizenship.

  • Once the positive sentence has been obtained and the decision is awaited definitive and final and unappealable, registration is carried out in public records, thus officially obtaining Italian citizenship.

It is not necessary travel: as it is a judicial process, clients are represented by the Italian lawyer, who will defend them in all scheduled hearings by the judge before the Italian Court, until conclusion.
